Deposit Agreement
Adopter agrees to the following:
On the day of _____________________, a deposit of $__________ has been received from the ADOPTER to be applied towards the total adoption price of the kitten described above. The balance due must be paid in full the day the kitten is picked-up from our Cattery.
The purpose of this deposit is to insure the ADOPTER’s intent to purchase the kitten described above. Once the deposit is received the kitten will not be sold to any other person unless the ADOPTER indicates in writing that he/she has changed his/her mind about the adoption and releases the kitten to be made available to another adopter. We do our best to try to place our kittens in loving homes in a timely manner, so they may bond with their new family. If a kitten is held specifically for an adopter, a change of mind can quite often jeopardize the chance for a particular kitten, having been reserved for the particular adopter, to be placed in a home while still at a desirable age. For this reason, deposits are non-refundable unless the BREEDER cannot provide the kitten as described above. The deposit may, however, be applied to another kitten should the original kitten become unfit for adoption, or the ADOPTER wants to wait for another available kitten in the future.
This Deposit Agreement serves as a guarantee for the amount of deposit. If the BREEDER fails to make available the kitten described above, the amount of the deposit will be refunded to the ADOPTER.
Personal checks are accepted on deposits only. Please pay balance due with cash, money order, or cashier’s check.
Adoption Agreement
Adopter agrees to the following:

The ADOPTER accepts the responsibility of caring for this cat and providing for its welfare. The ADOPTER agrees that this cat will always receive prompt, professional medical care, and will not be allowed to harbor parasites (internal or external). The ADOPTER agrees to provide this cat with quality food appropriate for its age. The ADOPTER agrees to provide companionship for this cat and not leave it alone for long periods of time without human attention. The ADOPTER agrees to provide this cat with a generous amount of exercise, playtime, and to provide it with cat toys. The ADOPTER agrees not to cage this cat except as needed for medical or isolation purposes, or introduction to other pets, on a temporary basis. The ADOPTER agrees that this cat is to be kept indoors and will not roam freely outside.

The cat is in good health to the best of the BREEDER’s knowledge. The cat was examined by the BREEDER’s Veterinarian on _______________ and was found to be in good health. See accompanying Health Certificate. The cat has had vaccines appropriate for its age, has been dewormed, and has been tested for Feline Leukemia (FeLV) and Feline Immunodeficiency Virus (FIV) with a negative result on ________________.

The ADOPTER agrees to have this cat examined by a Licensed Veterinarian within three working days after the adoption and to report any health problems to the BREEDER immediately. Expenses for any health problems determined to be contracted at BREEDER’S Cattery requiring veterinary treatment will be covered by the BREEDER.

In the case of a positive Elisa FeLV test, the cat must be re-tested immediately due to the incidences of false positives in this test.

The ADOPTER agrees to provide yearly veterinarian checkups for this cat and to vaccinate the cat appropriately for its age.

The ADOPTER agrees NOT to vaccinate this cat with the following: FIP (Feline Infectious Peritonitis), FIV (Feline Immunodeficiency Virus), or FeLV (Feline Leukemia). Make sure your Veterinarian is aware of this when you bring the cat in for the first exam after adoption, and for yearly checkups. Giving the FIP shot could cause the cat to develop the disease. Also, there is no need for the FIV or FeLV shots as the cat will not live outside and will not be exposed to the agents that could cause these diseases. Giving either of these vaccines will void your health guarantee.

This cat is being purchased as a PET only. The ADOPTER agrees and guarantees that this pet cat WILL NEVER be used for breeding. The ADOPTER agrees to have the cat spayed/neutered at the most timely age recommended by the ADOPTER’s Veterinarian and provide a Veterinarian’s certificate of spaying/neutering (including date of the procedure) to the BREEDER. The Cat Fancier’s Association (CFA) Registration application will be sent to the ADOPTER once proof of altering has been provided to the BREEDER. The CFA Registration will indicate that the cat will not be used for breeding.

The ADOPTER agrees NOT to de-claw the cat under any circumstances. De-clawing is considered a form of mutilation and extreme cruelty to the animal. Our Birman cats have been trained on scratching posts, so please be sure to have scratching posts available before you take your cat home.

Under NO circumstances will the BREEDER be held accountable for any veterinarian bills this cat may accumulate from the date of adoption forward. As with all living things, there is no guarantee of a future with no problems occurring. This includes any additional costs incurred from spaying/neutering.

GUARANTEE AGAINST FATAL GENETIC DEFECTS: If the cat should become deceased within 12 months from the date of adoption, and it is proven by a necropsy that the cause of death is a result of a genetic defect, the cat will be replaced with another cat of equal value as available. This necropsy would need to be done within 24 hours of the cat’s death and the results provided to the BREEDER within one week. This necropsy will be at the ADOPTER’s expense.

Under NO circumstances will cash money be refunded to the ADOPTER.

Under NO circumstances will the ADOPTER sell, lease, trade, or otherwise transfer the possession of this cat to any pet store, shelter, research laboratory, or similar facility. The ADOPTER agrees to inform the BREEDER immediately of any anticipated adoption or gift of this cat to any other person or persons, and will not transfer ownership of this cat without notification to the BREEDER. The BREEDER maintains rights for final approval of the sale, transfer, lease or gift of this cat to anyone other than the original ADOPTER. The BREEDER has the option of reclaiming the cat for zero dollars if proposed transfer is deemed by the BREEDER to not be in the best interest of the cat.

The ADOPTER agrees by signing of this Adoption Agreement to full release of this cat’s future veterinary records to Marali Birmans and gives Marali Birmans permission to discuss this cat’s status at any time in the future with whoever the ADOPTER is using for a Veterinarian at the time.

The BREEDER reserves the right to repossess the cat in the event of failure or refusal of the ADOPTER to comply with the terms of this agreement.
